Coinks® Terms and Conditions

Definitions

Points - a unit of loyalty currency providing the Member with collector points which can be redeemed for Rewards in the Programme.

Member - consumers of products who collect points for redemption against Rewards and who join the Programme.

Pack Owner- the brand owners which offer Points and/or Rewards under the Programme.

Programme – a marketing tool incorporating Coinks in which Rewards are offered to Members by Reward Providers via the Promoter and/or Rewards and/or Points are offered to Members by Pack Owners.

Promoter – Coinks Limited Woodland Granaries, Narrow Lane, Wymeswold, Leicestershire LE12 6SD

Promotional Packs- unique promotional packs which offer Rewards and/or Points under the Programme.

Rewards- a promotion offered by a Reward Provider and/or Pack Owner/Promoter.

Reward Provider- the brand owners (and/or the Promoter if applicable) which offer Rewards under the Programme.

By using and/or enrolling into the Programme, Members agree that they have read and understood these Terms and Conditions and agree to comply with them. These Terms and Conditions should be read in conjunction with all instructions and guidelines for registration into the Programme as set out on the Coinks® website www.coinks.com and any supplemental terms and conditions of a Reward Provider and/or Pack Owner which form part of these Terms and Conditions. In the case of conflict between these Terms and Conditions and any supplemental terms and conditions of a Reward Provider and/or Pack Owner, the latter shall take precedence. Participation in the Programme is provided at the sole discretion of the Promoter.

  1. This promotion is open to residents of the United Kingdom (England, Scotland, Wales and Northern Ireland) the Isle of Man and Channel Islands only excluding employees and their families of the Reward Providers and the Pack Owners. Employees [and their families] of the Promoter are excluded from entry into a prize draw on this website.

  2. Members must be 16 years or over.

  3. Points collected by Members can be redeemed as follows:

  4. In full redemption against a Reward offered by a Reward Provider and/or Pack Owner on Promotional Packs

  5. In part redemption together with a cash payment against a Reward offered by a Reward Provider and/or Pack Owner on Promotional Packs

  6. Where Promotional Packs feature a code, Members must cut out the code and keep it. In some cases, Members will be asked to send in their codes to validate a claim for a Reward or prize. If asked to do so, Members have 28 days in which to comply. After 28 days the Promoter reserves the right to remove, permanently, the corresponding Points from the Member's account.

  7. A Member can only have one account. Accounts created using automated devices or processes are not allowed and all such accounts will be removed from the Programme. The Promoter reserves the right, in its absolute discretion, to remove a Member from the Programme where multiple accounts are suspected, at which time any accrued Points balance will be null and void.

  8. The Promoter reserves the right, in its absolute discretion, to remove a Member from the Programme where it is felt that the Member could be misusing the Programme, is in breach of these Terms and Conditions or is otherwise acting contrary to the spirit of the Programme.

  9. A Member shall be responsible for any tax implications or payment of tax that may arise as a result of joining the Programme.

  10. A Member must have sufficient Points accrued before redeeming any Reward under the Programme.

  11. Points shall be subtracted from a Member's account immediately upon a Member choosing to redeem a Reward.

  12. When Rewards are supplied by the Reward Provider and/or the Pack Owner, the Promoter makes no warranty in respect of such Rewards. The Promoter disclaims any and all warranties, including, but not limited to, the implied warranties of satisfactory quality, fitness for purpose, and non-infringement. The Promoter is not responsible for those guarantees, warranties, and representations, if any, offered by Reward Providers or Pack Owners. No advice or information, whether oral or written, obtained by a Member under the Programme shall create any warranty by the Promoter.

  13. When Rewards are supplied by the Promoter this will be clearly stated in the Reward terms and conditions. Any enquiries regarding warranties or guarantees should be made in writing to the Promoter.

  14. When Rewards are offered using the Points + cash option, Members are entitled to cancel the contract up to seven (7) clear working days from delivery of the Reward by returning, at the Member’s own cost, the Reward to the Reward Provider. Beyond this period, the Reward is non-refundable and non-exchangeable; except in the event of a claim under the manufacturer’s warranty. This does not affect your statutory rights. Before or at the time the contract is concluded, the Member will be informed of the identity of the supplier, the main characteristics of the goods, the price (Points + cash), arrangements for delivery and the closing date of the offer, as well as the Members cancellation rights under Regulation 13 of The Consumer Protection (Distance Selling) Regulations 2000 (as amended). The supplier may substitute an equivalent item if the one requested is unavailable. If the Member wishes to cancel and return the substituted item, the Members costs will be refunded.

  15. Online payments made on this website are processed using a secure gateway to HSBC merchant services. Your details are required only for the purpose of the transaction and will not be retained by the Promoter. The Promoter will take all reasonable care to keep the details of your order and payment secure. In the absence of negligence on the Promoter’s part, the Promoter cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from this Website.

  16. Member's correspondence with or participation in the Programme is solely between corresponding Member and the Reward Provider and/or Pack Owner. The Promoter assumes no liability, obligation, or responsibility for any part of any such correspondence or promotion, including without limitation withdrawal or modification of any Reward.

  17. The legitimacy of any Reward refund is judged by the Reward Provider and/or Pack Owner and is their sole responsibility. A Member understands that there may be delay in crediting points for Rewards due to Reward Provider's failure to provide necessary information to the Promoter. The Promoter shall not be responsible or liable for the delay or failure to credit points in such event.

  18. The sale or barter of points is strictly prohibited. A Member's right to use Points within the Programme is non-transferable. Membership will terminate immediately in the event of a Member's death. Programme accounts and Point balances are not transferable upon death or otherwise by operation of law.

  19. A Member agrees to allow the Promoter to communicate with him/her via email with suitable offers, which may contain opportunities to earn and redeem. The Promoter will always use this communication method responsibly under the terms of the Data Protection Act 1998 and other self-regulatory restrictions. Members preferring not to receive such offers can visit their account information page and change their communication preferences to opt-out of receiving such offers from the Promoter.

  20. A Member agrees to allow the Promoter to pass on relevant details to Reward Providers only for the fulfilment of Rewards under the Programme. A Member agrees to allow the Promoter to pass on relevant details to Pack Owners for the provision of Points and/or Rewards under the Programme. By receiving Points and/or Rewards from Pack Owners, you agree to allow the Pack Owner to retain your registration details and agree to be contacted by the Pack Owner about future offers and promotions which may be of interest to you. You are able to unsubscribe from this communication at any time by contacting the Pack Owner, at which point your personal information will no longer be retained. All personal information relating to a Member will be used solely by the Pack Owner in accordance with current data protection legislation and will not be disclosed to any 3rd party without the Member’s prior consent.

  21. When a Member requests to leave the Programme there will be no further communication between the Promoter and the Member. The Member's account will be closed within 30 days and any unused Points will be forfeited.

  22. A Member expressly agrees their participation in the Programme is at the Member's sole risk. The Promoter MAKES NO WARRANTY WITH REGARD TO ANY REWARDS ACQUIRED BY MEMBERS FROM THE PROGRAMME OR THROUGH REWARD PROVIDERS AND/OR PACK OWNERS,UNLESS THE REWARD STATES THAT IT IS SUPPLIED BY THE PROMOTER; THAT THE PROGRAMME WILL MEET MEMBERS' REQUIREMENTS; OR THAT THE PROGRAMME WILL BE UNINTERRUPTED, TIMELY, ERROR FREE; NOR DOES THE PROMOTER MAKE ANY WARRANTY AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION ACQUIRED FROM THE PROGRAMME.

  23. The Promoter may from time to time adjust Members' Coinks® accounts upwards or downwards in respect to accounting errors, non-payment from Reward Providers and/or Pack Owners, multiple accounts, refunds issued, Rewards returned or suspected fraud, for which the Promoter has full authority in its sole discretion.

  24. The Promoter reserves the right to amend these Terms and Conditions and/or the operation of the Programme at any time upon reasonable notice. Any amendment shall be effective upon posting the modified Terms and Conditions and/or modified Programme on this Coinks® website and notifying Members either on the Coinks® website home page or via email. In the event of an amendment to these Terms and Conditions and/or the operation of the Programme, a Member's non-cancellation or continued use of the Programme after 30 days shall be deemed acceptance of the modified Terms and Conditions and/or Programme.

  25. The Promoter reserves the right to terminate the Programme at any time upon reasonable notice. Any notice of termination shall be posted on this Coinks® website. In the event of termination, a Member will have at least 30 days from the notice date of Programme termination to redeem any Points in accordance with these Terms and Conditions. Unless specified otherwise, no additional Points will be able to be accrued during this termination period.

  26. The Promoter will make every effort to communicate to all Members the termination period, however the Promoter will not be held responsible for failing to notify any individual Member regardless of the reason.

  27. The Promoter reserves the right at any time, and from time to time, providing as much notice as reasonably possible, to:

  28. Withdraw, modify or limit Rewards offered by Reward Providers and/or Pack Owners in the Programme and/or the number of Points required to redeem for Rewards.

  29. Change Reward Providers and/or Pack Owners under the Programme

  30. The Promoter reserves the right to refuse any application and to terminate the account of anyone that is believed to be in breach of the offer Terms and Conditions.

  31. Any attempt to deliberately damage the Website or the information on it, or to otherwise undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.

  32. Attempting to gain access to someone else’s account and/or account information, or trying to obtain, generate, or guess another users account information or to enter the same code more than once or use promotional codes not intended for use in this promotion is strictly forbidden and should any participant attempt to do this, their account will be deleted and they will be permanently banned from the Website. If this happens, the offending participant will forfeit his/her account and will not be permitted to participate in the Promotion any further. The Promoter may decide to take further action.

  33. Decision of Promoter in all matters is final and binding. The Promoter shall not be liable for any loss, damage or liability caused by matters relating to this offer.

  34. The Promoter and/or promotional partners will not be responsible if participants do not receive their reward if they have supplied insufficient, incorrect or false information when registering on the Website.

  35. The Promoter and/or promotional partners will not be liable for any delayed or non-delivery of emails to participants. It is the responsibility of the registered user to check that emails from the Promoter or its promotional partners will not be automatically classed as “junk” or “spam” and sent to the user’s junk mail filter or otherwise filtered or deleted.

  36. The Promoter cannot accept responsibility for any technical or other problems that mean participation is impossible or delayed, claims or entries are not accepted for any reason whatsoever.

  37. The Promoter and/or promotional partners do not guarantee continuous, uninterrupted or secure access to the Website. Numerous factors outside of the control of the Promoter and/or promotional partners may interfere with the operation of the Website. To the extent permissible by law the Promoter and/or promotional partners exclude all implied warranties, conditions and other implied terms.
